WILLS & POWERS OF ATTORNEY
YOUR WILL
Your Will may well be the most important legal document you will ever sign!
Your Will is the only way that you can determine how your assets will be divided amongst your loved ones and friends after you go.
For this reason you must be certain that it properly reflects your wishes, without any ambiguity, as to how you want your possessions distributed after you have passed away.
Disputes over Wills often occur because the Will is unclear and can be interpreted different ways. Such disputes are expensive, and can cause tremendous rifts in the family that often never heal.
Disputes may also occur because the Will lacks certain essential requirements, or has not been properly signed and witnessed.
Rea & Sockhill have over 30 years experience in assisting our clients to properly complete their Will.
We discuss your Will with you in detail to ensure that it is properly drafted and that it clearly expresses your desires and wishes. We will also see that it is correctly signed and witnessed.
If you have not yet made your will, or you are considering making changes to it, then please contact us for an appointment.
MUTUAL WILLS
Through the intriguing twists and turns of life you may find yourself in a situation where you would feel more comfortable knowing, that after you pass away your partner can not change their Will from that which you had both agreed on as appropriate whist you were both alive.
For example: if you had children from a previous marriage and you want to ensure that after your partner passes away that the house you both previously owned (or some other assets you had both agreed on) went to those children ... and that your partner was not influenced by somebody else after you had died to change their Will.
You can do this by you and your partner signing "Mutual Wills". This creates a contractual obligation on the survivor so that they cannot change their Will after you have passed away. By this process you can ensure that what you had both agreed on whilst you were both alive will take effect. Mutual wills are binding even if your partner remarries.
If you would like to discuss these options with us please contact us for an appointment.
YOUR POWER OF ATTORNEY
A Power of Attorney document is effective, once you sign it, to appoint another person to look after your financial affairs and certain health matters should you require it.
It is particularly useful if a person has lost their mental capacity to conduct their own affairs, or is out of the country and need some paperwork signed.
You should be very particular who you appoint as your "attorney". It should be someone you have great trust in and who is capable of making sound decisions about your affairs.
You do not loose any of your rights by appointing an attorney and you can revoke the appointment at any time whilst you are of sound mind.
If you believe a Power of Attorney document would be of benefit to you or you want more information then please contact us for an appointment.
